General Terms and Conditions of Use and Sale (T&Cs)

This document defines the terms and conditions for accessing and using the HyMarket platform, a marketplace for digital content (Mods, Prefabs, Assets), as well as the conditions of sale between Sellers and Buyers.
1. Purpose of the Service
HyMarket is a matchmaking platform allowing creators (hereinafter "Sellers") to offer digital content to users (hereinafter "Buyers"). HyMarket acts as a technical intermediary and shall not be considered the seller of products offered by third parties.
2. Registration and Payments
Access to buying and selling requires the creation of an account. To sell, the user must set up a Stripe Connect account. Transactions are processed by Stripe. HyMarket charges a 5% commission on each sale, deducted at the time of the transaction. The Buyer acknowledges that payment is immediate upon accessing the download.
3. Intellectual Property and Licensing
The Seller guarantees they hold all rights to the content they publish. By putting a product up for sale, they grant the Buyer a personal and non-exclusive license for use. Any resale, redistribution, or modification without the creator's express authorization is strictly prohibited in accordance with Intellectual Property laws.
Important Note: Right of Withdrawal
In accordance with European regulations on digital content, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium if the performance has begun after the consumer's prior express consent. By downloading a product on HyMarket, the Buyer expressly waives their right of withdrawal.
4. Liability
Seller: They are solely responsible for the compliance of their product and any necessary technical support.
HyMarket: The platform does not guarantee the absence of bugs in downloaded files, nor compatibility with third-party software. HyMarket shall not be held liable for any damage caused to the Buyer's system following the installation of third-party content.
5. Moderation and Security
HyMarket reserves the right to remove any malicious content (viruses, malware), plagiarism, or offensive content without notice or compensation. The Seller agrees to provide honest descriptions and safe files.
6. Governing Law and Disputes
These terms are governed by French law. In the event of a dispute between a Seller and a Buyer, HyMarket may act as a mediator without any obligation to achieve a specific result. Failing an amicable agreement, the French courts shall have exclusive jurisdiction.
